1. Acceptance of Terms

By downloading, installing, or using THRIFTEAZ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

THRIFTEAZ is a mobile application that uses artificial intelligence to help resellers identify, price, and prepare listings for second-hand items. The App is provided by THRIFTEAZ LLC, a Utah limited liability company ("we", "us", "our").

3. Eligibility

You must be at least 13 years old (16 in the EU) to use the App. By using the App you represent that you meet this requirement.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to share your account or use another person's account without permission.
• You must provide accurate information when creating an account.
• Notify us immediately at thrifteazadmin@gmail.com if you suspect unauthorised use of your account.

5. Subscriptions and Purchases

• Free tier: 5 AI scans per day, with up to 5 additional scans earned by watching rewarded ads.
• Pro (monthly / annual): unlimited scans, advanced AI identification, voice-style descriptions, and priority support.
• Scan Packs: one-time purchase of additional scans that do not expire.
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date via your App Store or Google Play account settings.
• We do not offer refunds except as required by applicable law or App Store / Google Play policy.

6. AI Pricing Disclaimer

Prices suggested by THRIFTEAZ are estimates based on AI analysis and available market data. They are provided for informational purposes only and do not constitute financial advice. Actual resale values may differ. We accept no liability for losses arising from reliance on suggested prices.

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or circumvent any security measures.
• Use automated tools (bots, scrapers) to access the App or its APIs.
• Upload content that is unlawful, harmful, or infringes third-party intellectual property.
• Resell, sublicense, or commercially exploit the App without our written permission.

8. Intellectual Property

The App, its design, code, and content are owned by The Collective and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial reselling purposes.

9. User Content

You retain ownership of photos and other content you upload. By uploading content you grant us a limited licence to process and store it in order to provide the service. We do not use your content for AI training without explicit consent.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from the Me tab → Settings → Delete Account.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated via in-app notice.

13. DMCA Notice and Takedown

If you believe that content uploaded to THRIFTEAZ infringes your copyright, send a written notice to our designated agent at thrifteazadmin@gmail.com including:

• A description of the copyrighted work you claim has been infringed.
• A description of where the allegedly infringing material is located within the App.
• Your full name, mailing address, telephone number, and email.
• A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorised to act on the copyright owner's behalf.
• Your physical or electronic signature.

If we receive a valid notice we will remove or disable the material in question, notify the user who uploaded it, and pass on a counter-notice if one is provided. Repeat infringers will have their accounts terminated.

14. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah.
